Schengen residence permit

A residence permit in the Republic of Lithuania  shall grant an alien the right to reside in the Republic of Lithuania, to choose a place of residence in the Republic of Lithuania, to change the place of residence, to depart from and return to the Republic of Lithuania during the period of validity of the residence permit. The residence permit is valid in all Schengen states, so obtaining Lithuanian Residence permit one actually receives a Schengen Residence permit and this means migration to the Europe.  Lithuania, however, wants you to pay some taxes here, so your company may operate in all EU area, as any other EU company, but if you want residence permit in Lithuania, you have to pay majority of the taxes here.

There are two types of residence permits: temporary and permanent residence permit.

Upon the first application normally a temporary residence permit is issued. It is valid for one year and then has to be prolonged.

 A temporary Schengen residence permit may be issued to an alien if:

  • the alien has retained the right to citizenship of the Republic of Lithuania (Article 41, Law on the Legal Status of Aliens),
  • it is a case of family reunification (Article 43),
  • the alien intends to work in the Republic of Lithuania (Article 44),
  • the alien intends to engage in lawful business activities in the Republic of Lithuania (Article 45),
  • the alien intends to study (Article 46),
  • the alien has been put under guardianship/custody (Article 47),
  • the alien is or has been a victim of human trafficking and co-operates with the pre-trial investigation body or with the court in the fight against trafficking in human beings or in combating the offences linked to trafficking in human beings (paragraph 1 of Article 49),
  • the alien intends to carry out scientific research (paragraph 2 of Article 49).

A permanent Schengen residence permit may be issued if:

  • the alien has retained the right to citizenship of the Republic of Lithuania according to the procedure established by the Republic of Lithuania Law on Citizenship;
  • the alien is a person of Lithuanian descent;
  • the alien has entered the Republic of Lithuania for residence together with a citizen of the Republic of Lithuania as his family member;
  • the alien has lost citizenship of the Republic of Lithuania but resides in the Republic of Lithuania;
  • the alien is a child under the age of 18, born in the Republic of Lithuania and his parents or one of the parents are citizens of the Republic of Lithuania whose place of residence  has been  declared in the Republic of Lithuania or who holds a permanent residence permit;
  • the alien is a child under the age of 18, born outside the Republic of Lithuania and his parents or one of the parents are citizens of the Republic of Lithuania whose place of residence has been declared in the Republic of Lithuania or who holds a permanent residence permit;
  •  the alien has been granted refugee status in the Republic of Lithuania;
  • the alien has been residing in the Republic of Lithuania uninterruptedly for the last five years holding a temporary residence permit;
  • the alien submits the judgment certifying the juridical fact that the alien resided in the Republic of Lithuania until 1 July 1993 and is residing in the Republic of Lithuanian at the moment;
